End User Statement
Ultimate Consignee / End-Use / End-Destination Declaration
In order to comply with export control and sanctions laws, Deepwater Corrosion Services (“Deepwater”) requires that this form be completed, signed and returned for order processing to proceed. If you cannot meet these conditions, please be aware that Deepwater will be unable to process your order.
1. Ultimate Consignee/ End User/ End Destination Country
I certify that I am the end-user and ultimate consignee of the items requested from Deepwater and will use the items in the country in which I am located (indicated in signature block below). I certify that, if I am not the end-user and will resell the items requested from Deepwater, I will ensure any resale does not breech conditions listed in sections 2 to 5 below.
2. End Use. I certify the products, technology, software and/or services to be provided will not be used for any prohibited use, including the following: nuclear, military, missiles, or weapons (chemical or biological). Specifically, the products, technology, software and/or services are not for a military end-use (including for incorporation into a military end-item), and are not for a military end-user in China, Russia or Venezuela. Additionally, the equipment will not be used directly or indirectly in exploration for, or production of, oil or gas in deepwater (greater than 500 feet), Arctic offshore, or shale projects, where such use would be prohibited without the applicable government approval.
3. Sanctioned Countries. I certify Deepwater items will not be sold or transferred to any country subject to comprehensive U.S., UK, or EU sanctions (currently including the Crimea region of Ukraine, Iran, Cuba, North Korea, or Syria) or to any other country subject to sanctions where supply of such items would be prohibited without applicable government approval, including to Russia for use directly or indirectly in exploration for, or production of, oil or gas in Russian deepwater (greater than 500 feet) or Arctic offshore locations or shale formations in Russia.
4. Denied Parties. I certify the products, technology, software and/or services will not be sold or transferred to any company, organization, entity, or individual on any of the various denied parties lists established by the U.S., UK, and/or EU, including without limitation, the U.S. Department of the Treasury’s (Office of Foreign Assets Control) Specially Designated Nationals list, the U.S. Department of Commerce’s (Bureau of Industry and Security) Denied Persons List or Entity List, among others. Further, we certify that we are not owned (owned in the aggregate, directly or indirectly, 50% or more by one or more individuals) or controlled by any individual that is listed of any of the various denied parties lists above.
5. Acknowledgement of Export / Reexport License Requirement. Products, technology, software and/or services provided by Deepwater may require an export or reexport license from the U.S., UK, and/or EU prior to being exported or reexported and such controlled products, technology, software and/or services will not be exported or reexported without all required export or reexport license(s).
By signing below, I certify that I am authorized to sign this Declaration on behalf of my organization, that all of the facts contained in this statement are true and correct, that we do not know of any additional facts that are inconsistent with the above statements, and that I will immediately provide notice of any change to the information provided above.
